THE HIGH BAR® – STATEMENT OF PRIVACY

This Privacy Policy was updated on May 5, 2020. Your continued use of the Services constitutes your acceptance of the updated policy.

By visiting www.hitthehighbar.com or www.writeforthebar.com or making use of The High Bar’s Services (defined below), you are accepting the practices outlined in this Privacy Policy, our Terms of Service (https://hitthehighbar.com/terms/), and our Refund/Cancellation Policy (https://hitthehighbar.com/refund/). Some terms used in this Privacy Policy are defined in our Terms of Service.

This Privacy Policy applies to “Personal Information” collected by The High Bar from users of The High Bar websites located at www.hitthehighbar.com, www.writeforthebar.com, and all associated sites linked to the foregoing by The High Bar (collectively, the “Sites”), together with the services provided by The High Bar through the Sites and through The High Bar’s bar examination preparation services (collectively the Sites and services are the “Services”). The Services are the property of Hit The High Bar, LLC (“The High Bar”) and its licensors.

“Personal Information” includes any information that can be used on its own, or with other information, to identify or contact a single person or to identify an information in context. If we can link particular information to an individual, we will consider that information to be “Personal Information,” and we will protect it.

Here at The High Bar, we are committed to safeguarding your privacy. This Privacy Policy (“Privacy Policy”) describes the information we gather through the Services, what we do with it, and the safeguards we have in place to protect it. Please note that this Privacy Policy applies only to information collected through The High Bar’s Services.

Before you submit any information to The High Bar, please read this Privacy Policy for an explanation of how we will treat your Personal Information. By using any part of the Services, including without limitation any part of the Sites, you consent to the collection and use of your Personal Information as outlined in this Privacy Policy and our Terms of Service. Some terms used in this Privacy Policy are defined in our Terms of Service. You also consent to the collection, processing and maintenance of your information in the United States. If you do not agree to this Privacy Policy or our Terms of Service, please do not use the Services. Your use of any part of the Services indicates your acceptance of this Privacy Policy, of our Terms of Service, and of the collection and use of your Personal Information in accordance with this Privacy Policy.

PLEASE NOTE THAT WE OCCASIONALLY UPDATE THIS PRIVACY POLICY AND THAT IT IS YOUR RESPONSIBILITY TO STAY UP TO DATE WITH ANY AMENDED VERSIONS. IF WE MODIFY THE PRIVACY POLICY, WE WILL NOTIFY YOU VIA EMAIL. ANY CHANGES TO THIS PRIVACY POLICY WILL BE EFFECTIVE IMMEDIATELY UPON PROVIDING NOTICE, AND SHALL APPLY TO ALL INFORMATION WE MAINTAIN, USE, AND DISCLOSE. IF YOU CONTINUE TO USE THE APPLICATION FOLLOWING SUCH NOTICE, YOU ARE AGREEING TO THOSE CHANGES.

THE PERSONAL INFORMATION WE COLLECT

When you use the Services, we collect a variety of information, including Personal Information.

  • Information you provide. When using the Services, you may provide information about yourself, such as your email, name, address and billing information. This may occur, for example, when you register for the Services, create a profile, engage The High Bar for Services or otherwise interact with the Services. You may also provide information about a third party through the Services, for example, if you refer a friend or colleague via email. We may combine this information with other information we collect from your interaction with the Services or from other companies.
  • In addition, when you subscribe to The High Bar’s Services you must provide information to The High Bar’s third-party payment processor supporting a valid payment method, including credit card information. This information will include accurate and complete billing information including your full name, address, state, zip code, telephone number, and valid payment method information. By submitting such payment information, you authorize The High Bar to charge all purchases and fees incurred through your account to your credit card. You also agree to be bound by our third-party payment processor’s terms of use and privacy policy. You understand and agree to not hold The High Bar liable for any adverse effects that actions (whether intentional or unintentional) on the part of our third-party payment processing service may cause.
  • Cookies and Web beacons. When you visit The High Bar’s Sites, we transfer cookies to your computer to uniquely identify your browser, to keep track of when you were last on the Sites, and to track what you last searched on the Sites. The use of cookies helps us improve the quality of the Services to you, by identifying information which is most interesting to you, tracking trends, or storing information you may want to retrieve on a regular basis, such as test preparation materials you find most helpful. So while you are free to disable cookies in your browser, we recommend that you leave them activated so you can benefit from The High Bar’s most useful features. In order to help The High Bar analyze how people are using the Sites, we also authorize third party services, such as Google Analytics, to use cookies and other tracking technologies to access Personal Information about visitors to the Sites. The Google Analytics service provides us with demographic data about The High Bar’s users on an anonymous basis, and makes use of a cookie that can be recognized by Google or its affiliate DoubleClick when you visit other websites. If you would like to prevent your data from being used by Google Analytics, you can follow these steps. Also, the pages on the Services may include Web beacons or pixels, which are electronic files to count users who have visited that page, to track activity over time and across different Web sites, to identify certain cookies on the user’s computer accessing that page, or to collect other related information, and this information may be associated with your unique browser, device identifier, or Internet Protocol address. We may, for example, implement a pixel on the pages of the Services where you view certain bar preparation information, so that we can track whether you visit a Web site associated with that information at a later time.  

PROTECTION OF YOUR PERSONAL INFORMATION

  • The High Bar Security. We take reasonable administrative, physical and electronic measures designed to protect the information that we collect from or about you from unauthorized access, use or disclosure. But please be aware that no method of transmitting information over the Internet or storing information is completely secure. If we learn of a security concern, we may notify you through the email address you have provided to us or send you a notification through the Services.
  • Personal Device Security. You are responsible for protecting information stored on your personal device. The High Bar has no control over your device’s physical security or security settings, and it is your responsibility to establish any device-level security protections you feel are appropriate (e.g., password protection, encryption, remote wipe capability, etc.).
  • Phishing Attacks. We will never send you an email requesting your account information, username, password, social security number or payment information, and you should never respond to any email requesting this information. If you do receive such an email, do not respond and do not click on any links or attachments found within. If you receive such an email purportedly from The High Bar, please notify us at info@writeforthebar.com.
  • Location of your Personal Information. We store the information we collect from you in the United States. If you are located outside the United States and choose to use our Sites, we may store and process the information you provide to us in the United States.

SHARING OF YOUR PERSONAL INFORMATION

  • With third parties that help to power our Services. The High Bar has a limited number of service providers and other third parties (“Business Partners”) that help us run various aspects of our business. These Business Partners are contractually bound to protect your Personal Information and to use it only for the limited purpose(s) for which it is shared. Such third-party uses may include, but are not limited to, the provision of services such as data hosting, IT services, and billing management.
  • With third parties and the government when legal or enforcement issues arise. We may share your Personal Information, if reasonable and necessary, to (i) comply with legal processes or enforceable governmental requests, or as otherwise required by law; (ii) cooperate with third parties in investigating acts in violation of this Agreement; or (iii) bring legal action against someone who may be violating the Terms of Service or who may be causing intentional or unintentional injury or interference to the rights or property of The High Bar or any third party, including other customers.
  • With third parties in the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of The High Bar’s corporate entity, assets, or stock (including in connection with any bankruptcy or similar proceedings).

We may also, from time to time, rent or sell aggregated data and/or other information that does not contain any personal identifiers (i.e., if the information has been anonymized by stripping out identifiers such as name, address, phone number, etc.). The purpose of this type of disclosure is to provide research institutions and other interested parties real-world information about the usefulness of engaging in bar examination preparation services.

EMAIL COMMUNICATIONS

We may send you emails about your account, searches, test preparation efforts, essay responses, test preparation progress, and The High Bar’s Bar Exam Preparation Services. If you opt-in to also receive marketing email messages, The High Bar may also send you communications with The High Bar-related news, surveys or promotions. If you do not want to receive alerts or marketing emails from us, you can click the unsubscribe link in the bottom of the unwanted email.

DELETING MY PERSONAL INFORMATION

You may delete your The High Bar account by clicking “Unsubscribe” on your Account View.  We may keep a copy of your account information for our records.

INFORMATION SUBMISSION BY MINORS

The Sites and Services are meant for adults. We do not knowingly collect personally identifiable information from individuals under the age of 18, and the Services are not directed at individuals under the age of 13. If you are a parent or legal guardian and think your child under 13 has given us information, you can email us at info@writeforthebar.com to have the information removed. Please include the following subject line in your email: “COPPA Information Request.”
